👥 Introduction

Data subject rights are fundamental to GDPR and present unique implementation challenges in AI contexts. When individuals exercise their rights, AI systems must be capable of responding - from explaining how decisions were made to deleting data from trained models.

This part examines how each key data subject right applies to AI systems and provides practical guidance for operationalizing these rights throughout the AI lifecycle.

💡 Key Challenge

Traditional data systems can easily locate, modify, or delete specific records. AI systems, particularly ML models, encode information across millions of parameters in ways that make identifying and removing individual data influence technically complex. Organizations must design for rights compliance from the outset.

Data Subject Rights Overview

GDPR establishes eight core data subject rights. Each has specific implications for AI systems that process personal data.

🔍 Right of Access in AI Contexts

The right of access requires organizations to provide data subjects with all personal data being processed, including AI-derived inferences, predictions, and classifications that relate to them.

📜 What Must Be Disclosed

  • Input data: Personal data used in AI processing
  • AI outputs: Predictions, scores, classifications, and recommendations about the individual
  • Processing purposes: Why AI is used and what decisions it supports
  • Logic involved: Meaningful information about the AI logic (see Article 22)
  • Sources: Where data came from, including if inferred by AI
  • Recipients: Who receives AI outputs about the individual
  • Retention: How long data and AI outputs are kept

⚠ AI-Specific Challenges

Inferred Data: AI may derive sensitive insights (health predictions, creditworthiness) that constitute personal data requiring disclosure, even if never explicitly collected.

Model Parameters: While individual weights need not be disclosed, the fact of processing and meaningful explanation of logic must be provided.

Technical Format: Data must be provided in intelligible form - raw model outputs may need human-readable translation.

📖 Access Request Example

A loan applicant requests access to their data. The response should include: (1) provided application data, (2) credit score assigned by AI, (3) risk classification and factors contributing to it, (4) the decision outcome, (5) explanation of how the AI assessed their application, and (6) any data obtained from third-party sources. Simply providing raw application data without AI-generated assessments would be incomplete.

Right to Rectification in AI

The right to rectification applies to all personal data, including AI-generated inferences. When data is inaccurate, or when AI has made incorrect conclusions, individuals can request correction.

  • Implement mechanisms for manual override of AI outputs
  • Log corrections and their downstream effects

🗑 Right to Erasure and Machine Unlearning

The right to erasure presents unique challenges for ML systems. When data has been used to train a model, simply deleting source records may not remove its influence on the model. "Machine unlearning" addresses this challenge.

❌ The Machine Unlearning Challenge

Traditional ML models encode patterns from training data across all parameters. An individual's data influences the entire model in ways that cannot be easily isolated or removed. Complete erasure may theoretically require retraining from scratch without that individual's data - often impractical for large models.

Approaches to Machine Unlearning

  • Full Retraining: Retrain model from scratch excluding the data to be erased. Gold standard but often impractical.
  • Approximate Unlearning: Algorithmic techniques to remove specific data influence without full retraining.
  • Sharded Training: Design models trained on data shards; remove shard and retrain only that portion.
  • SISA (Sharded, Isolated, Sliced, Aggregated): Architecture designed for efficient unlearning.
  • Deletion Records: Document erasure requests and ensure excluded from future training.

📋 Regulatory Perspective

Regulators have acknowledged machine unlearning challenges. The ICO guidance suggests that where technical removal from a model is impractical, organizations should: (1) delete source data, (2) prevent future use in training, (3) document impossibility and proportionality, and (4) consider model retirement timelines. However, this is not blanket immunity - design choices that make erasure impossible may themselves be non-compliant with privacy-by-design.

🤖 Article 22: Automated Decision-Making

Article 22 provides specific protections against automated decision-making, including profiling, when decisions have legal or similarly significant effects on individuals.

⚖ Article 22 GDPR - Key Provisions

General Prohibition: Data subjects have the right not to be subject to decisions based solely on automated processing, including profiling, which produces legal effects or similarly significantly affects them.


Exceptions (22(2)): The prohibition does not apply if the decision is:

  • (a) Necessary for entering into or performing a contract
  • (b) Authorized by EU/Member State law with suitable safeguards
  • (c) Based on explicit consent

Safeguards Required: Where exceptions apply, the controller must implement suitable measures to safeguard data subject rights, including at minimum: the right to obtain human intervention, the right to express their point of view, and the right to contest the decision.

When Article 22 Applies

⚠ Meaningful Human Involvement

To avoid Article 22 application, human involvement must be meaningful:

  • The human must have authority to override the AI decision
  • They must actually exercise discretion and consider relevant factors
  • They must not simply approve AI outputs as a formality
  • They must have sufficient time and information to meaningfully review
  • Targets or incentives should not discourage overrides

  • Identify all AI decisions with legal or significant effects
  • Assess whether decisions are "solely automated"
  • If Article 22 applies, identify applicable exception
  • Implement meaningful human oversight mechanisms

🗣 Right to Explanation

Articles 13-15 and 22 require provision of "meaningful information about the logic involved" in automated decision-making. This creates a qualified "right to explanation" for AI decisions.

The explanation should include:

  • Processing description: What AI processing occurs and for what purpose
  • Logic involved: How the AI system works in general terms
  • Significance and consequences: What the processing means for the individual
  • Key factors: Main variables influencing the decision
  • Individual factors: Why this specific decision was reached (where feasible)
📖 Explanation Example: Credit Decision

Poor explanation: "Our AI system analyzed your application and determined you do not qualify."

Better explanation: "Your application was assessed using automated credit scoring. The system considers factors including payment history, debt levels, and income stability. Your application was declined primarily due to: (1) recent missed payments on record, (2) high credit utilization ratio. You have the right to request human review of this decision and to provide additional information for consideration."
